{PBJFlorida} FW: 8 Ways to Help Close Guantanamo!

 

Friends,

 

Here is an updated list of actions you can take to help end the human rights crisis carried out in our names at Guantanamo. 

 

As you know, the situation there is dire. The military has now admitted that over 100 of the 166 detainees are on hunger strike. (Defense lawyers say all of the detainees are in fact on strike.) A number are being force fed, including Shaker Aamer, who has been cleared to leave since 2007 but remains held without charge after 11 years despite the UK government calling for him to be free with his wife and children in London. He is one of dozens who have been cleared to leave but remain in limbo. We have to do more to end this human rights tragedy.

 

What are we asking for?

>President Obama must restart transfers of cleared detainees (this can happen under current law) and keep his promise to close the prison

>Congress must repeal and not renew its restrictions on transfer of detainees to the US mainland for trial in federal court or its conditions on transfers to other countries. 

 

How will my action make a difference?

>We use the power of collective action - each of us doing a small part - to convince President Obama and Congress to respect human rights. Each call, letter, email and demonstration is like putting money in the bank - it may not seem like much, but over time our investment grows as we educate, raise awareness and recruit more people to our effort. We will get Guantanamo closed! It took about 15 years to get the infamous Tamms Supermax prison in Illinois closed, but activists got it done!

3) Join the 167 Project = detainee167.tumblr.com

>Show solidarity against human rights violations at Guantanamo by sending a photo of yourself with a sign that says "I am detainee 167" to Detainee167@gmail.com. The photos will be posted at http://detainee167.tumblr.com. This project was created by activist Harry in NYC and will be used to raise awareness online.

Dear Secretary Hagel:

 

I am writing as a concerned citizen to express my profound dismay at my government's failure to end the abomination that is the prison at Guantanamo Bay, Cuba.  It is a disgrace that, more than 4 years after President Obama issued an executive order requiring the prison to be closed within a year, not only does it remain open, but it is hard to discern that any effort is being made to close it.  To the contrary, I understand that the Department of Defense has requested nearly $200 million to renovate it.

 

Meanwhile, a widespread hunger strike among the remaining detainees has persisted since February, reflecting the detainees' desperation and seriously threatening their health.  There have been credible reports that some of the detainees have been force-fed, in a manner that contravenes medical ethics.

 

As you know, many of those still detained at Guantanamo were cleared for release or transfer by a panel consisting of representatives of all the major defense and national security agencies.  Yet still they are held, with no end in sight to their detention, with no opportunity to know exactly why they are being held, and with no opportunity to challenge the evidence against them.  

 

I have to believe that you, as well as President Obama and other administration officials, agree that this cannot continue.  The persistence of Guantanamo is blatantly incompatible with our own Constitution and our obligations under international law, including the International Convention on Civil and Political Rights.  Consequently, it profoundly undermines the ability of the United States to command the respect of other nations and to influence the behavior of other governments, particularly relating to their compliance with international norms.  Over the long term, our acceptance of Guantanamo corrodes the moral fiber of our society.  We simply cannot continue to think of ourselves, and represent ourselves, as a society that values fairness, justice, and the rule of law at the same time that we allow a prison to exist at Guantanamo where all of those values are thwarted with each passing day.

 

I respectfully urge you to do everything in your power to persuade members of Congress and other administration officials to bring this illegal and immoral detention regime to a prompt end.  The provisions of the National Defense Authorization Act that limit transfers of detainees out of Guantanamo must not be renewed, and the Authorization for the Use of Military Force that Congress enacted in the days after 9/11 must be repealed.

I am very concerned that a widespread hunger strike has been underway since early February by many of the detainees at Guantanamo Bay.  Whatever precipitated the hunger strike, it seems undeniably attributable in large part to the hopelessness of the detainees' predicament.   I, as an American, am deeply dismayed at the U.S. government's failure to bring their indefinite detention to a conclusion that is consistent with our obligations under the U.S. Constitution and international law.  

 

It is shameful and embarrassing to every American that the persistence of Guantanamo – more than 4 years after President Obama issued an executive order requiring its closure – has been denounced by the United Nations High Commissioner for Human Rights, the International Committee of the Red Cross, and other respected and impartial international human rights monitors.  How can we hope to influence other governments to respect human rights when our own government continues to indefinitely detain men at Guantanamo without charge or trial, in clear violation of our obligations under the International Convention on Civil and Political Rights and other international human rights standards?

 

I respectfully urge you to undertake a thorough review of the current situation at Guantanamo and make every effort to reduce tensions between the detainees and the detaining authorities there.  I also urge you to ensure that those on hunger strike have access to independent medical care, in conformance with medical ethics, including the principle of informed consent to any treatment and intake of nutrients.  

 

At the same time, there needs to be a new sense of urgency about closing the prison there.  It is simply unacceptable – and blatantly at odds with the basic principles of fairness, justice, and the rule of law with which most Americans identify their country – to continue to detain these men without charge or trial.  The injustice of this situation is underscored by the fact that so many of the detainees were long ago cleared for release or transfer by an interagency task force.   Closing Guantanamo means that the provisions of the National Defense Authorization Act that limit transfers of detainees out of Guantanamo must not be renewed, and the Authorization for the Use of Military Force that Congress enacted in the days after 9/11 must be repealed.  Please do everything in your power to convince members of Congress and President Obama of the urgency of this task.

"TIMELY JUSTICE ACT" WOULD HAVE EXECUTED  INNOCENT FLORIDIANS

Evidence of Innocence Withheld Many Years

 

Tallahassee, FL - April 29, 2013 – The Florida Legislature has now passed the "Timely Justice Act." It is aimed at speeding  up and increasing executions by "streamlining" the process through limiting appeals and mandating prompt Death Warrants.

 

Since Florida resumed executions in the 1970's,  twenty-four wrongfully convicted Death Row prisoners have been exonerated (the largest number of wrongfully convicted and exonerated death-sentenced prisoners of any state in the country) while seventy-five prisoners have been executed. "That's one exoneration for every three executions," said Mark Elliott, Director of Floridians for Alternatives to the Death Penalty.

 

"Legislation that speeds executions by limiting appeals will almost certainly lead to the execution of innocent men and women," Elliot added.

 

The Death Penalty Information Center lists Florida Death Row inmates who were under a sentence of death for more than 10 years before being exonerated by new evidence of their innocence:

James Richardson (21 years), Juan Melendez (18), Rudolph Holton (16), Frank Lee Smith (14), Freddie Pitts (12), Wilbur Lee (12), Joseph Brown (13), and Seth Penalver (13).

 

According to the Innocence Project of Florida, in January, 2000, some 14 years after his death sentence, Frank Lee Smith died of cancer on Florida's Death Row. After his death, DNA testing not only confirmed his innocence, but identified the real perpetrator.

 

Just four months ago, Seth Penalver became Florida's 24th exonerated Death Row prisoner. Penalver was released after 18 years in prison and on Death Row. "If executions are sped up, then we will be killing innocent people like me." said Penalver.  "Evidence of my innocence was withheld and hidden for almost eighteen years after my conviction." Seth Penalver is one of eight Floridians who were exonerated more than ten years after being sentenced to death. "Executing innocent people is murder by all, not justice for all," said Penalver.

Juan Melendez was on Florida's Death Row for almost 18 years for a crime he did not commit. A "lost" confession by the real perpetrator was presented some 16 years after his conviction. Melendez was exonerated and freed.

 

"Under the Timely Justice Act now before the Florida Senate, these innocent men would have been executed." Said Elliott. "No one knows how many more innocent people are now awaiting execution on Florida's Death Row – and will be executed, if the Legislature places limits on their appeals."

 

"It is both tragic and ironic that the state that sends the highest number of wrongfully convicted people to Death Row is attempting to speed  up executions." said Elliott. According to the Death Penalty Information Center, the average time spent on Florida's Death Row by the wrongfully convicted is close to 8 years. Some were on Florida's Death Row for 18 to 20 years before being exonerated and released. "Speeding up executions and limiting appeals risks making murderers out of all of us." Speeding up and increasing the number of executions virtually guarantees that innocent people will be executed." said Mark Elliott.

 

Florida has the nation's second largest Death Row with 405 people, according to the Death Penalty Information Center's latest report, The Death Penalty in 2012: Year End Report. Florida also sentences far more people to death than any other state.  Last year, Florida had 22 new death sentences out of 78 nationally---that's more than one quarter of ALL new death sentences in the U.S.

 

"It is obvious why Florida has such a large Death Row." Said Elliott, "With one out of every four of the nation's new death sentences along with one exoneration for every three executions, the focus should be on how Florida sentences so many people to death, especially so many innocent people, not on executing more people faster." said Elliott. "For those who support executions, it has to be more important to get it right than get it done."

 

"This legislation is not only dangerous, it is unwarranted and unnecessary," said Elliott. "Some legislators are exploiting the fact that some inmates have spent years on Death Row, but the facts show that time spent on Death Row in Florida prior to execution is almost 2 years less than the national average."  The Florida Department of Corrections, Death Row Roster lists average length of stay on Florida's Death Row prior to execution as 13.22 years. The U.S. Bureau of Justice report, Capital Punishment , 2010 lists the average time nationally between sentencing and conviction as 14.83 years.

 

"Florida's system of state executions  is like a rickety old public bus that costs millions of dollars to operate. The brakes are shot and the steering is out and it is constantly crashing into innocent people. The answer shouldn't be  to pack in more passengers, hit the gas and go faster?" asked Elliott.

 

"We need answers, not more executions," said Elliott. "Florida's government program for the Death Penalty is broken, not because it is too slow, but because it is a hugely expensive, wasteful, government program that, with all its wrongful convictions, risks making murderers out of us all. Speeding it up will guarantee that.  Whether legislators support or oppose the death penalty, everyone should be concerned about a system that has led to more people being released from Death Row because of evidence of their innocence and wrongful conviction than any other state, some after 18 – 20 years  The last thing the legislature should do is to speed up the process and ensure that that the State will execute innocent people."

Mid – Sr. Ruby on Rails Developer

Experience
• Must have 4-5 years of experience working with Rails in a high scale environment.
• Must be a Ruby on Rails Expert.
• Understand scaling Rails (and all applications) and bring unique solutions for doing so
• Be able to jump in and code all aspects of their app, from front to back.
• Experience working within a Mac environment

Skills Experience:
• Strong Ruby skills including meta programming, testing frameworks
• Deep understanding of Rails, from loading the stack to generating templates
• Capacity to bring multiple libraries together and build something even better
• Strong scripting skills
• Command of common and theyb based protocols such as HTTP, SSL, SSH, SFTP
• Strong understanding of Message Queue and focus on File Management
• Using SCM tools, especially GIT.
• Understanding/Utilization/Creation of deployment strategies across multi-faceted architecture
• Knowledge of the underpinnings of UNIX (installing software, monitoring, administration)
• Database skills such as writing queries, making indexes, and knowing more than just ActiveRecord
• Scaling in all aspects from the front end to the far backend
• APIs, creating them, consuming them and all the authentication business that comes with it.
• Rails 3.2 with Mongoid and Solr on the back end and Ember.Js on the front end
• Experience testing in Respc environment.
• Must be good with javascript, especially with Ember.js, Angular.js or Backbone.js experience
